{"id":1948,"date":"2026-02-17T14:40:14","date_gmt":"2026-02-17T20:40:14","guid":{"rendered":"https:\/\/uwm.edu\/governmentrelations\/federal-government-priorities\/guidance-on-federal-immigration-activity\/"},"modified":"2026-02-17T16:55:27","modified_gmt":"2026-02-17T22:55:27","slug":"guidance-on-federal-immigration-activity","status":"publish","type":"page","link":"https:\/\/uwm.edu\/governmentrelations\/federal-government-priorities\/guidance-on-federal-immigration-activity\/","title":{"rendered":"Guidance on Federal Immigration Activity"},"content":{"rendered":"\n<p>UWM will comply with all applicable laws and is&nbsp;committed to cooperating with law enforcement within the constraints of the law and our own delegated responsibilities.&nbsp;<\/p>\n\n\n\n<p>We are committed to maintaining a safe and inclusive environment that facilitates university operations and our university\u2019s mission, including students\u2019 ability to access education without disruption.&nbsp;<\/p>\n\n\n\n<p>UWM strives to create an environment that protects privacy and the rights of students, faculty and staff under the law.&nbsp;<\/p>\n\n\n\n<p>UWM provides information on the immigration status of its students, faculty\u202for staff only when required by law.&nbsp;<\/p>\n\n\n\n<p>UWM will continue to closely monitor federal\u202fimmigration\u202fpolicies and enforcement that may affect our students, faculty and staff.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-public-safety\">Public Safety<\/h2>\n\n\n\n<div class=\"uwm-p-accordion\" data-accordion-prefix-classes=\"uwm\" data-accordion-cool-selectors=\"1\"><button class=\"uwm-p-accordion--toggle-button size-p-md\">Expand All<\/button>\n<div class=\"uwm-p-accordion--header\"><strong>What role do campus departments of public safety, such as\u202f the UWM Police Department,\u202f play in the actions of federal agencies concerning enforcement of immigration laws?\u202f<\/strong>\u00a0<\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>UWMPD has a set of procedures and practices it follows related to immigration\u202fenforcement, and its officers will not detain or arrest an individual solely based on a suspected violation of immigration law and will not routinely inquire about an individual\u2019s immigration status.\u202f<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>Will UWMPD participate in federal immigration\u202f enforcement\u202f operations?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>No.\u202fUWMPD will not\u202fparticipate\u202fin federal immigration enforcement actions.\u202fFederal agents must use\u202fappropriate legal\u202fprocesses if they are on campus and\u202fwish to contact individual students or employees about enforcement-related issues.\u202f\u202f<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>Does\u202f an individual\u2019s \u202fimmigration status\u202f affect\u202f how\u202f UWMPD \u202fprovides public safety\u202f services?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>No.\u202f An individual\u2019s immigration status does not\u202fdetermine\u202fwhether UWMPD will provide\u202fcampus and community safety-related services and will only be relevant if the\u202findividual is involved in serious crimes. An individual\u2019s immigration status does not affect their ability to file a police report with UWMPD.\u202f<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>Will the university issue\u202f RAVE Alerts\u202f or some other notification if\/when federal law enforcement is sighted on campus?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>The university does not typically use\u202fRAVE Alerts\u202fto notify\u202fcampus\u202fof federal or other law enforcement presence.\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>UWM uses RAVE Alerts to provide information about an immediate, actively occurring, and confirmed\u202femergency situation\u202fon campus \u2014 or a situation with the potential to affect campus \u2014 that requires the community to take immediate action\u202fto\u202fstay safe.\u202f\u202f\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>If an incident becomes an imminent threat to the health or safety of students or employees on campus, a\u202fRAVE Alert may\u202fbe issued.\u202f&nbsp;<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>Should I call UWMPD if I\u202f see \u202ffederal\u202f agents \u202fon\u202f campus?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>A sighting of, or an arrest by, federal law enforcement on campus does not\u202fnecessitate\u202fa call to 911\u202for the UWMPD non-emergency line\u202funless\u202fone of the\u202fbelow\u202fcriteria apply:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Your physical safety, or that of someone else, is in immediate jeopardy\u202f<\/li>\n\n\n\n<li>There is civil disorder or a likelihood of violence\u202f<\/li>\n\n\n\n<li>Destruction of property is occurring<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>Who should I call\u202f if I am approached by a federal\u202f law enforcement officer \u202fin a campus facility or workplace?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>If approached by a federal law enforcement officer\u202fon campus, employees should\u202fimmediately\u202fcall the UWMPD at <a href=\"tel:414-229-4627\">414-229-4627<\/a> and the Office of Legal Affairs at <a href=\"tel:414-229-4278\">414-229-4278<\/a> and ask to speak with one of the attorneys. Additional\u202fdetail\u202fon these interactions is included in\u202fthe section below.<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>For off-campus areas, what policies does the Milwaukee Police\u202f Department \u202ffollow on immigration?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>The Milwaukee Police Department has its own <a href=\"https:\/\/city.milwaukee.gov\/ImageLibrary\/Groups\/mpdAuthors\/SOP\/130-FOREIGNNATIONALS-DIPLOMATICIMMUNITY-IMMIGRATIONENFORCEMENT1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">posted policies on the issue (PDF)<\/a>.<\/p>\n<\/div><\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-federal-law-enforcement-access-to-campus-spaces\">Federal Law Enforcement Access to Campus Spaces<\/h2>\n\n\n\n<div class=\"uwm-p-accordion\" data-accordion-prefix-classes=\"uwm\" data-accordion-cool-selectors=\"1\"><button class=\"uwm-p-accordion--toggle-button size-p-md\">Expand All<\/button>\n<div class=\"uwm-p-accordion--header\"><strong>Can\u202f the\u202f university\u202f prohibit\u202f federal law enforcement agencies from coming on campus?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>Generally, no.\u202fHowever, federal agents are only able to access public spaces. Access to\u202fnon-public areas requires a warrant.\u202fPublic and non-public spaces are addressed below.\u202f\u00a0<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>What should I do if a government agent comes to my workplace?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>If any outside government agent comes to your workplace:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Stay calm and remain professional.\u202f\u202f&nbsp;<\/li>\n\n\n\n<li>Ask the agent for their name and to see their government-issued badge.\u202fMost likely the\u202fagent will show you their badge without you asking. If not, it is your right to ask for this.\u202f\u202f<\/li>\n\n\n\n<li>Verify the agent\u2019s identity and agency with a badge and ask the agent why they are on\u202fcampus, if\u202fthey have not shared that information already.\u202f<\/li>\n\n\n\n<li>Ask the agent to have a seat in a waiting room or lobby. If you do not have such a space, politely ask them to wait where they are while you try to reach the proper contacts.\u202f<\/li>\n\n\n\n<li><strong>Call the UWM Police Department at <a href=\"tel:414-229-4627\">414-229-4627<\/a> and the Office of Legal Affairs at\u202f <a href=\"tel:414-229-4278\">414-229-4278<\/a> and speak with one of the attorneys. <\/strong>Tell the attorney the following\u202finformation: \u201cAgent X from the Department of Y is here to talk to you about Z.\u201d Do not leave a\u202fvoicemail\u202fmessage with Legal Affairs.<\/li>\n\n\n\n<li>If no one from Legal Affairs is available, tell the agent that no one is available right now. Ask the agent if they can come back another time.\u202f<\/li>\n\n\n\n<li>Do not give the agent access to any paper files or access to any computer systems. Agents are free to enter any public areas of your workplace but must have a valid search warrant to enter a non-public area.\u202f<\/li>\n\n\n\n<li>Once on site, the UWMPD will also record the situation with body-worn cameras and document the actions being taken.<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>What should a student employee do if approached?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>If the agent approaches a student worker first, the student should\u202fimmediately\u202fget their supervisor. If their supervisor is not available, the student worker should find another manager in their unit.<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>What happens once I call OLA? Will a representative of OLA speak with the federal agent?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>The attorney on call will ask the caller to describe the encounter in detail and review the contents of the warrant or any other legal document that is presented to the employee. If you can, scan or photograph the warrant.<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>What happens if the federal agent ignores my request?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>If agents disregard your instructions or requests, do not interfere with their actions.\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>If agents act \u2014 with or without awaiting guidance from you or others on campus and regardless of whether they have presented a warrant \u2014 it is important that you do not intervene or block their movement,\u202fas obstructing or otherwise interfering with law enforcement activity can be a crime.<\/p>\n<\/div><\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-public-vs-non-public-areas\">Public vs. Non-Public Areas<\/h2>\n\n\n\n<div class=\"uwm-p-accordion\" data-accordion-prefix-classes=\"uwm\" data-accordion-cool-selectors=\"1\"><button class=\"uwm-p-accordion--toggle-button size-p-md\">Expand All<\/button>\n<div class=\"uwm-p-accordion--header\"><strong>What portions of UWM\u2019s workspaces are accessible?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>Agents are free to enter any public areas of your workplace but must have a valid warrant to enter a non-public area. Employees may say to the law enforcement agent, \u201cI am not authorized to give you consent to enter or accept legal documents,\u201d and contact the UWMPD and Office of Legal Affairs\u202fas directed above.<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>What constitutes a public area?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>As a public\u202finstitution, many\u202fareas within\u202fthe\u202fcampus and its facilities are open to the public. Generally, federal law enforcement officers are authorized by law to enter public spaces without special permission. Public areas may include sidewalks; green spaces; parking lots and ramps; and lobby, waiting, or hallway areas that are open to the public. Campus\u202flibraries and museums that are open to the public are also generally considered public areas. Campus events, such as lectures, forums and performances that are free and open to the public, or meetings subject to the Wisconsin Open Meetings law are also generally deemed to be public areas.<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>What\u202f are non-public \u202fareas?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>Some university areas, such as faculty, staff and student offices, residence halls, laboratories, and areas accessible only by a key or key card, are not open to the public without permission.\u202f\u202f<\/p>\n\n\n\n<p>Classrooms during class sessions are considered non-public areas. Other non-public spaces would include areas only available to staff or individuals with a staff escort, areas\u202fholding events that require a ticket for admittance, privately or university-owned vehicles, and other areas as long as there is a reasonable expectation of privacy in that space.\u202f\u202f<\/p>\n\n\n\n<p>Generally, federal law enforcement may not enter non-public areas without permission from\u202findividuals authorized to provide permission\u202fon behalf of the\u202funiversity, unless the officer presents a valid warrant or exigent circumstances are present.\u202f<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>What constitutes a valid warrant?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>A valid\u202fwarrant must be signed and dated by a judge. It will include a period within which the search must be conducted, a description of the premises to be searched, and a list of items to be searched for and seized (e.g., payroll records, employee identification documents, etc.).<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>Can I\u202f post a sign to restrict access to my classroom, building or other space?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>Only\u202fauthorized university officials such as Facilities Planning &amp; Management and\/or building managers may affix signage restricting access inside campus buildings. Signs are not to be placed on exterior doors of campus facilities.\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>Classrooms and instructional labs are already non-public areas while in use for instruction and do not need signs for this purpose. Research and instructional areas can also be restricted from entrance by the public. If you have labs and other research areas that are already treated as restricted but do not have official UWM signs, you can work directly with Campus Planning to request official signs.&nbsp;<\/p>\n\n\n\n<p>Private offices are already regarded as non-public areas and do not need signage to restrict access.&nbsp;<\/p>\n\n\n\n<p>For other areas where public access is not intended, please reach out to OLA if you have questions about whether additional signage is necessary and advised.&nbsp;<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>Can a student refuse to allow a\u202f federal law enforcement agent to enter a residence hall room without a judicial warrant?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>Yes. A residence hall room is considered a non-public and cannot be legally accessed by federal law\u202fenforcement officers without a valid judicial\u202fwarrant, the\u202fvoluntary consent of the occupant, or exigent circumstances. A student need not allow entry to any law enforcement officer who is not in possession of a judicial warrant.<\/p>\n<\/div><\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-additional-privacy-information\">Additional Privacy Information<\/h2>\n\n\n\n<div class=\"uwm-p-accordion\" data-accordion-prefix-classes=\"uwm\" data-accordion-cool-selectors=\"1\"><button class=\"uwm-p-accordion--toggle-button size-p-md\">Expand All<\/button>\n<div class=\"uwm-p-accordion--header\"><strong>Does UWMPD use\u202f cameras with automatic recognition technology?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>The UWM Police Department uses a limited number of automated license plate reader (ALPR) cameras (e.g., Flock Safety), which capture still images of vehicles, to support our critical mission of keeping our campus community safe.\u202f&nbsp;<\/p>\n\n\n\n<p>ALPR cameras support crime prevention and investigations by helping UWMPD quickly\u202fidentify\u202fvehicles tied to serious incidents or crimes, such as stolen vehicles, Amber Alerts, violent offenses, and missing persons. The cameras are focused on vehicle data \u2014 not individuals. The technology captures license plates and vehicle characteristics from fixed, visible public locations. It does not gather personal identity details about drivers or passengers, and it does not use facial recognition.\u202f&nbsp;<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>Are automated camera images used to track people?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>The images collected from ALPR cameras are still images capturing vehicle information and are not used to\u202frandomly monitor\u202for track individuals\u2019 movements on\u202fcampus or to conduct random or continuous surveillance. They are not used to track vehicles for immigration enforcement, nor do they have the capability to identify drivers or vehicle occupants through facial recognition.\u202f&nbsp;<\/p>\n\n\n\n<p>Per UWMPD policy, internal access to the ALPR system is restricted to authorized UWMPD personnel only. All access and use are logged and audited to ensure compliance with UWMPD policy and procedures.\u202f<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>Does UWMPD share immigration data from traffic stops or other police interactions with students, staff, or faculty with federal immigration authorities?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>No. UWMPD does not share information gathered from routine encounters with federal authorities.<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>What if law enforcement officers or federal or other agencies request private student information? Will the university give it to them?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>UWM will not provide information on the immigration status of its students, faculty, or staff unless required by law. If asked by an agent to provide private information\u202fabout a student, faculty or staff member, the employee may say \u201cI am not authorized to\u202fprovide the requested information,\u201d and contact the Office of Legal Affairs.\u202f&nbsp;<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\"><strong>Can the Office of Legal Affairs represent individuals for personal legal matters?<\/strong><\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p>No. OLA represents the university, including employees acting in their official capacities. OLA does not represent faculty, staff\u202for students in personal legal matters outside the scope of their business as university officials.\u202f\u202fIndividuals needing personal legal assistance may contact the <a href=\"https:\/\/www.mkebar.org\/hire-an-attorney\" target=\"_blank\" rel=\"noreferrer noopener\">Milwaukee Bar Association Lawyer Referral &amp; Information Service<\/a> at <a href=\"tel:414-274-6768\">414-274-6768<\/a> or the <a href=\"http:\/\/www.wisbar.org\/forPublic\/INeedaLawyer\/Pages\/LRIS.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">State Bar of Wisconsin Lawyer Referral and Information Service<\/a> at \u202f<a href=\"tel:608-257-4666\">608-257-4666<\/a> or <a href=\"tel:608-257-3838\">608-257-3838<\/a>.
