{"id":11076,"date":"2026-08-10T09:41:33","date_gmt":"2026-08-10T14:41:33","guid":{"rendered":"https:\/\/uwm.edu\/cie\/?page_id=11076"},"modified":"2026-09-15T09:28:47","modified_gmt":"2026-09-15T14:28:47","slug":"rule-impacting-f-and-j-visa-holders","status":"publish","type":"page","link":"https:\/\/uwm.edu\/cie\/services\/students\/rule-impacting-f-and-j-visa-holders\/","title":{"rendered":"Fixed Period of Admission and Extension of Stay Procedure"},"content":{"rendered":"\n<section class=\"uwm-u-py-80\"><div class=\"uwm-l-container--base uwm-l-container--overflow-hidden\">\n<div class=\"uwm-l-row\">\n<div class=\"uwm-l-col\">\n<div class=\"uwm-l-col\"><header class=\"page-header\"><h1 class=\"entry-title heading-separator\">Fixed Period of Admission and Extension of Stay Procedure<\/h1><\/header>\n\n\n<p class=\"default wp-block-paragraph\">The federal government published its final rule on <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/07\/17\/2026-14439\/establishing-a-fixed-time-period-of-admission-and-an-extension-of-stay-procedure-for-nonimmigrant\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cEstablishing a Fixed Time Period of Admission and Extension of Stay Procedure\u201d<\/a> on July 17, 2026, which impacts F and J international students and scholars.&nbsp;The rule was scheduled to go into effect on Sept. 15, 2026.&nbsp;<\/p>\n\n\n\n<div class=\"uwm-p-notice uwm-p-notice--info\"><div class=\"uwm-p-notice--content\"><div class=\"uwm-p-notice--title\">Implementation Update<\/div><div class=\"uwm-p-notice--message\">On Sept. 14, 2026, a federal judge issued a nationwide preliminary injunction which blocked the Fixed Period of Admission and Extension of Stay Procedure from taking effect on Sept. 15, 2026. D\/S&nbsp;allowed&nbsp;lawful&nbsp;stay&nbsp;in the U.S.&nbsp;through&nbsp;completion of&nbsp;F-1\/J-1 activities, without a&nbsp;maximum&nbsp;duration.&nbsp;<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\">What is the maximum length of an AUD?\u00a0<\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<ul class=\"wp-block-list\">\n<li>An&nbsp;AUD will be limited to the program end date listed on the I-20\/DS-2019, not to exceed 4 years.&nbsp;<\/li>\n\n\n\n<li>An AUD will also include the 30-day post-completion grace period.&nbsp;<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\">Is it possible to\u00a0apply for\u00a0an extension of the AUD?<\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<ul class=\"wp-block-list\">\n<li>Yes,&nbsp;F and J visa holders can request an extension&nbsp;to their AUD.&nbsp;<\/li>\n\n\n\n<li>An \u201cExtension of Stay\u201d (EOS) procedure has been&nbsp;established.&nbsp;<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\">What\u00a0is the procedure\u00a0to\u00a0apply for\u00a0an\u00a0\u201cExtension of Stay\u201d (EOS)?\u00a0<\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<p class=\"wp-block-paragraph\">There are two ways to request an Extension of Stay&nbsp;of&nbsp;the AUD:&nbsp;<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>An Extension of Stay application (form I-539) can be filed with USCIS along with an application fee; or&nbsp;<\/li>\n\n\n\n<li>An Extension of Stay can be requested when reentering the U.S. after international travel.&nbsp;<\/li>\n<\/ol>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\">Will students still be granted a\u00a0Grace\u00a0Period after program and\/or employment authorization completion?<\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<ul class=\"wp-block-list\">\n<li>Yes. A 30-day&nbsp;grace period is granted&nbsp;upon&nbsp;successful&nbsp;completion of&nbsp;a&nbsp;program and\/or&nbsp;completion of F-1\/J-1 activities&nbsp;(previously 60&nbsp;days).&nbsp;<\/li>\n\n\n\n<li>The grace period will be reflected in the AUD.&nbsp;<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<div class=\"uwm-p-accordion--header\">Are there any\u00a0Transition\u00a0Provisions\u00a0for visa holders\u00a0admitted to the U.S. under\u00a0Duration of\u00a0Status (D\/S)?\u00a0<\/div><div class=\"uwm-p-accordion--panel\"><div class=\"uwm-p-accordion--panel-inner uwm-u-clear\">\n<ul class=\"wp-block-list\">\n<li>Yes, there are transition provisions listed for students&nbsp;who are&nbsp;admitted to the U.S. under D\/S,&nbsp;are in the U.S. on the effective date, and&nbsp;do not internationally travel.&nbsp;<\/li>\n\n\n\n<li>On the rule effective date, D\/S will automatically be converted to a fixed AUD. The fixed AUD will be limited to the program end date listed on the I-20\/DS-2019, not to exceed 4 years from the rule effective date, plus the grace period.<\/li>\n\n\n\n<li>There are&nbsp;specific&nbsp;allowances for eligibility for F-1 students to keep their 60-day grace period.&nbsp;<\/li>\n\n\n\n<li>The&nbsp;EOS application requirement&nbsp;will be&nbsp;waived for students applying for OPT&nbsp;or STEM OPT Extension&nbsp;before&nbsp;March 18, 2027.&nbsp;<\/li>\n<\/ul>\n<\/div><\/div>\n<\/div>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\"
